Edward L. White, Jr.

v.

General Assembly Counciland the Board of Pensions of the Presbyterian Church (U.S.A.)

On February 12, 2000, a letter written by Edward L. White, Jr., ("Complainant"), was received by the Stated Clerk of the General Assembly, in which Mr. White wrote "Please find enclosed my Statement of Intent and Complaint to the General Assembly Council and the Board of Pensions of the PCUSA [sic]." Consultation with Mr. White by the Manager of Judicial Process in the Office of the Stated Clerk confirmed that he wished his correspondence to be treated as a complaint per Chapter VI of the Rules of Discipline. Copies of this correspondence were sent to the Executive Director of the General Assembly Council and the President of The Board of Pensions.

Pursuant to D-6.0307, the Moderator, Clerk, and Executive Committee of the General Assembly Permanent Judicial Commission have made a preliminary determination that the complaint should be dismissed because Complainant as a member of a Presbyterian congregation does not have standing to file a complaint under D-6.0202b.

The Commission has examined the papers in this matter and affirms the findings of the officers. Therefore, the complaint is dismissed.
