REMEDIAL CASE 214-9
This remedial case has come before this Commission on appeal
by Elizabeth Combier (Appellant) from a decision of the Permanent
Judicial Commission of the Synod of the Northeast.
The Commission has determined that it
has jurisdiction, that the appellant has standing to file the
appeal, that the appeal was properly and timely filed, and that
the appeal states one or more of the grounds for appeal in D-8.0105.
The Commission has further determined,
however, that there is no claim for which relief can be granted.
The appellant's request for "costs, attorney's fees and compensation
for distress" is beyond the purview of this commission.
It is therefore ORDERED that the case
be dismissed. IT IS FURTHER ORDERED that the Stated Clerk of
the Synod of the Northeast report this decision to the Synod
at its first meeting after receipt, that the Synod enter the
full decision upon its minutes, and that an excerpt from those
minutes showing entry of the decision be sent to the Stated
Clerk of the General Assembly. IT IS FURTHER ORDERED that the
Stated Clerk of the Presbytery of New York report this decision
to the Presbytery at its first meeting after receipt, that the
Presbytery enter the full decision upon its minutes, and that
an excerpt from those minutes showing entry of the decision
be sent to the Stated Clerk of the General Assembly. IT IS FURTHER
ORDERED that the Clerk of the Session of the Madison Ave. Presbyterian
Church, report this decision at its first meeting after receipt,
that they enter the full decision upon its minutes, and that
an excerpt from those minutes showing entry of the decision
be sent to the Stated Clerk of the General Assembly. Leon Fanniel
and Mildred Morales, members of the Commission, were not present
for the deliberations and final decision.
